Part A — General terms for every booking
1. Quotes and prices
Website package prices describe the listed inclusions and are guides. Extra requirements may change the price. The written quote sets the final scope, total price in Australian dollars (AUD), timing, deliverables, add-ons and any usage rights. A quote is open for seven calendar days from issue unless it states another expiry. A quote does not reserve a date or time. Mevista may accept another booking until the deposit has cleared and the booking is confirmed. Mevista is not registered for GST as at the effective date and does not charge GST. If GST registration changes, the quote will show the applicable tax treatment. Travel, extra time, people, locations, props, edited images, priority turnaround and additional coverage are charged only if the quote describes and prices them. Prop hire is subject to availability. No extra charge is added without the client’s written approval.
2. Quote acceptance
The client accepts the quote and these terms once through the electronic acceptance attached to the quote. The quote identifies the service category and the version number and date of these terms. The acceptance record identifies the client, accepted quote and terms, acceptance time and any separate consent choices. Mevista provides the client with a copy. The Privacy Notice is made available for reading and acknowledged separately in the same flow. Optional photo-feature permission is a separate, unticked choice; acceptance of the quote is not marketing permission. No separate signature is required on these terms.
3. Booking and payment
A date and time are not held until Mevista accepts the booking and the 50% deposit has cleared. Mevista sends written booking confirmation after both steps. The deposit is part of the total price and is credited to the booking; clause 6 explains what happens to it if the date changes or the booking is cancelled. The remaining 50% is due by the end of the shoot day. For remote work with no shoot day, the quote states the balance due date. Payment options are listed in the quote or invoice. Bank transfer is available; cash may be agreed in advance; a secure payment link is offered only when an active provider is included on the invoice. Do not send card details by email. A payment is recorded as received only after cleared funds or cash have been verified.
4. Scope and changes
The accepted quote describes the agreed work, date or delivery schedule, location, participants, deliverables, editing, add-ons and usage. If a requested change expands the work, Mevista explains any effect on price, timing or deliverables and obtains written approval before starting the extra work. The client supplies accurate booking details and tells Mevista about access, safety, accessibility or timing needs.
5. Location, council permits and property access
Council permits: Mevista is responsible for identifying and arranging any council permits required for Mevista’s photography or content work at a council-controlled or public location, unless the accepted quote expressly sets out a different arrangement. The quote will state any known permit fee or related cost and how it is treated in the price. Mevista will not proceed at a location where a required permit or approval has not been obtained. If a required permit or approval cannot be obtained in time, Mevista tells the client promptly and the client chooses either to move the booking to a new date, with the deposit carried over and no new deposit required, or to cancel and receive a full refund of amounts paid.
Business client’s own premises: Where a business books Mevista to work at premises controlled by that business, the booking confirms the business’s consent and authority for Mevista to access and photograph or record the agreed areas for the quoted project. A separate property-consent form is not required for that business premises booking. The business must tell Mevista about site restrictions and identify any separate approval needed from a landlord, venue, another owner or an affected person.
A third party’s private home: If a client such as a tradesperson books Mevista to work at a private home controlled by someone else, the client is responsible for obtaining the homeowner’s written permission for Mevista’s access and the agreed photography or recording, and providing that permission before the shoot. Mevista is not responsible for arranging that homeowner permission. If it is not provided, Mevista may defer the work until access is authorised.
Other access: The client identifies any non-council venue or property access requirements not covered above and cooperates in obtaining the relevant owner or venue approval. Responsibility for council permits remains with Mevista as stated above. Any permit, venue, property, travel or related fee included in the job must be stated in the quote.
6. Rescheduling, cancellation and lateness
Reschedule with at least 48 hours’ notice: The client may reschedule once without a fee, subject to availability. The deposit carries over to the new date and no new deposit is required. Notice is counted back from the scheduled start of the shoot or session (for remote work with no shoot day, from the date work is due to begin under the quote). A further reschedule request is treated as a cancellation and a new booking.
Cancellation with at least 48 hours’ notice: If the client cancels with at least 48 hours’ notice, Mevista refunds the deposit in full. Where work has already started on a project with no shoot day (for example a remote UGC project), Mevista may keep a reasonable amount for work completed and for reasonable, unavoidable costs disclosed to and approved by the client before they were incurred, and refunds the rest.
Reschedule or cancellation with less than 48 hours’ notice: Mevista holds the date, prepares for the booking and usually cannot fill the time at short notice. If the client reschedules or cancels with less than 48 hours’ notice, or does not attend (see below), Mevista keeps the deposit as a genuine and reasonable estimate of that loss, not as a penalty. The amount kept never exceeds the deposit paid. A replacement date is a new booking under a new quote and a new deposit. If Mevista is able to re-book the same date and time, Mevista refunds the retained deposit less any costs it has actually incurred.
Lateness: Please contact Mevista as soon as possible if you will be late or cannot attend. A 15-minute arrival grace period applies. The session normally finishes at its scheduled end time; extra time depends on availability and written approval of its cost before it starts. If the client has not arrived or contacted Mevista within 30 minutes after the start time, Mevista may treat the session as cancelled with less than 48 hours’ notice.
Illness and exceptional circumstances: Illness should be raised promptly; Mevista may offer an additional fee-free change for exceptional circumstances, with the deposit carried over. These terms do not limit rights that cannot legally be excluded.
7. Weather, safety and cancellation by Mevista
Mevista may pause or reschedule a shoot where weather, access or other conditions create a safety risk or materially affect the agreed work. The parties will try to agree on a replacement date without an extra session fee, and the deposit carries over. If no suitable date is agreed, Mevista refunds amounts paid for services not supplied, subject to rights that cannot legally be excluded. If Mevista cannot attend, Mevista contacts the client promptly and offers a replacement date or refunds amounts paid for services not supplied. Mevista may pause or stop work where a person, animal, equipment or lawful access is at risk.
8. Editing, delivery and galleries
The quote states the deliverables and any included image-download allowance. The standard photography delivery target is two weeks after the shoot; vehicle sale-listing sessions have a three-business-day target. Video and other project delivery dates are stated in the quote. If a delay is likely, Mevista will tell the client. Where an online gallery is supplied, access is intended to remain available for four weeks from delivery, after which Mevista removes the gallery. The client should download and back up files during that period. Mevista keeps backup copies for the period set out in the Privacy Notice and may be able to re-supply files after the gallery is removed, but recovery is not guaranteed and any recovery fee is agreed before work starts.
Pixieset is an independent third-party provider Mevista uses for client gallery delivery and may use for additional digital-image purchases, prints and related services. Pixieset is not a partner or agent of Mevista. Where its gallery store is enabled, clients place gallery-store orders through Pixieset under the terms, privacy practices, payment, print fulfilment and shipping arrangements presented by Pixieset and its relevant providers. Mevista does not operate or control those provider-run services, including the emails Pixieset sends from its own systems. Questions about an order or provider service should be directed to the provider. Mevista remains responsible for its own services and obligations, and nothing in these terms excludes rights that cannot legally be excluded. Any gallery-store purchase is separate from the shoot invoice.
9. Copyright, edits and optional promotion
The applicable service part below and the accepted quote set copyright and the client’s permitted use. Mevista is the author of the work it creates and keeps its moral rights, including the right to be credited and the right not to have the work altered in a way that misrepresents it. Delivered images and videos are finished, edited work and are to be used as delivered, apart from the limited edits each service part allows, because further edits can misrepresent Mevista’s work. Credit is not required unless the quote says so. Mevista consents to the edits and uses that these terms or the accepted quote expressly allow.
Personal clients: Portfolio or marketing use of an identifiable person, property or the client’s personal work always requires separate, optional permission.
Business and UGC clients: Unless the quote says otherwise, Mevista may show the delivered work, and identify the client by name and logo, in its portfolio, website and social media as an example of its work. The client may opt out at any time by emailing hello@mevistastudios.com.au. Mevista honours any confidentiality, embargo or launch date written in the quote and does not publish before it. This does not cover identifiable individuals, who always need to give separate, optional permission.
Individual choices: Each adult decides for themselves; a client cannot give publicity permission on behalf of another adult. For a child, a parent or legal guardian records the choice and the child’s views are considered in an age-appropriate way. A child who objects will not be featured in Mevista marketing. If an individual or property-owner choice cannot be captured in the quote, Mevista records that choice separately in writing. A “no” does not change the booking or service.
Withdrawing permission or opting out: A person can withdraw an optional permission, or a business can opt out of portfolio use, at any time by emailing hello@mevistastudios.com.au. Mevista records the withdrawal on the client’s record, stops using the material in new posts and promotion, and removes it from its website and its own social media accounts within 14 days. Mevista cannot recall material already printed, shared or reposted by others but will take reasonable steps to limit further use. Withdrawal has no effect on the booking, the service, the price or any licence the client holds.
10. Lost files, equipment failure and liability
Mevista takes reasonable care with client files, uses professional equipment and keeps backup copies of work for the period set out in the Privacy Notice. If files are lost or corrupted, a delivery cannot be completed, or equipment fails, and this is outside Mevista’s reasonable control, Mevista will re-supply the affected files from backup, redo or reshoot the work where that is possible and practical (a one-off event cannot be re-created), or refund the amounts paid for the affected services.
For business and UGC bookings, to the extent the law allows, Mevista’s liability for any failure in the services, including lost or corrupted files or equipment failure, is limited to re-supplying the services or refunding the amounts paid for them. For personal bookings, nothing in this clause limits any consumer guarantee or other right that cannot legally be excluded, and the options above are in addition to those rights.
11. Complaints and legal rights
Australian Consumer Law and other mandatory rights continue to apply. If the client has a concern, they can contact hello@mevistastudios.com.au with the client or job reference and a description of the issue. Mevista will respond and try to resolve it promptly. If the concern is not resolved, the client may contact Consumer Protection WA. Nothing in these terms limits a right that cannot legally be excluded.
12. Electronic records
The electronic quote acceptance is the one acceptance step for the quote and applicable terms. The acceptance page identifies the quote and terms, allows the client to read them, records the client’s clear acceptance and time, and provides a copy. Privacy acknowledgement and optional marketing choices are recorded separately. These records are stored with the client job file and backed up as described in the Privacy Notice.
13. Changes to these terms and governing law
Mevista may update these terms from time to time. Each version has a version number and an effective date. The version identified on the accepted quote applies to that booking and is not changed by a later version unless the client agrees in writing. An updated version applies to quotes issued on or after its effective date.
These terms are governed by the law of Western Australia, and the parties submit to the non-exclusive jurisdiction of the courts of Western Australia, without limiting any mandatory rights. If any part of these terms cannot be enforced, the rest continues to apply.
Part B — Personal photography only
14. Personal photography: deliverables and image selection
This part applies to family, pets, couples, maternity, portraits, personal events and personal vehicle sessions. Mevista provides the session and edited deliverables listed in the accepted quote. The quote states the session duration, people or pets, location, included edited images or downloads, delivery target, add-ons and final price. Mevista selects and edits the photographs before delivery unless the quote describes a client-selection process. Additional images or prints are available only if the gallery store is enabled and its prices and terms are shown to the client before purchase. A gallery, if supplied, is intended to stay open for four weeks from delivery.
15. Personal photography: copyright, personal use and edits
Mevista and the client expressly agree that Mevista retains copyright in commissioned photographs to the extent the law allows. This agreed copyright arrangement forms part of the quote the client accepts. After the agreed invoice is paid, the client may download, keep, print, share with family and friends, and post the photographs delivered or purchased for personal purposes, including on personal social accounts. The client may not sell the photographs or use them to promote a business without Mevista’s written permission. This personal-use permission continues for the client’s downloaded copies after a gallery link expires and applies only to images included in or purchased under the accepted quote.
Edits and credit: Delivered images are finished, edited work and must not be edited, retouched, filtered, re-coloured or otherwise altered, because further edits can misrepresent Mevista’s work. Resizing or cropping to fit a print size, frame or social media format is fine if it does not change the look or meaning of the image. Credit is not required unless the quote says so, although crediting Mevista Studios when sharing is appreciated.
Selling your own vehicle: A private individual selling their own personal vehicle, for example through an online marketplace or classified advertisement, who is not acting as or for a dealer or other business, is a personal client. Using the delivered images to advertise that sale is personal use under this clause. A person who sells vehicles in the course of a business, or who acts for a dealership, books under Part C (see clause 20).
16. Personal photography: participants, children and pets
The booking client confirms they are authorised to arrange the session and will tell participants how it will run. Each adult participant makes their own optional photo-feature decision. A parent or legal guardian must provide any permission needed for a child; the child’s views are considered in an age-appropriate way, and a child who objects will not be featured in Mevista marketing. If a pet is included, the client is responsible for its control and handling. Mevista may pause or stop the session if a person, animal, equipment or lawful access is at risk.
Part C — Business photography and casual short-form social content only
17. Business scope and categories
This part applies to business photography and casual short-form social content. It is not a commercial video-production offering. The quote identifies the authorised client contact, brief, locations, people/products/premises, deliverables, file formats, timeline, price and usage rights. Where useful, the quote identifies one or more categories: People & Team, Products & Premises, and Work in Action. The actual number of people, products, locations, set-ups and activities is as stated in the quote. Complex products, elaborate lighting, additional people or locations and extra coverage are included only where described and priced. Additional work requires written approval before it begins. This part also applies to vehicle photography for dealerships and salespeople, which has additional terms in clause 20.
18. Business work: copyright, licence and edits
Mevista retains copyright in work it creates unless the quote expressly states a different written arrangement. After the agreed payment is made in full, the client receives only the licence described in the quote. The quote identifies permitted channels and purposes, such as website, organic social media, internal use, print or paid advertising, and states any term, territory, exclusivity, whitelisting or sublicensing rights. If a use is not stated, it is not included. Rights in music, stock, fonts, templates, trademarks and other third-party material remain subject to the owner’s licence.
Permitted edits: Delivered images are finished, edited work. Within the licensed uses, the client may add text, captions, post information, logos, graphics and overlays, crop and resize images for the channel, and place them into layouts, posts and advertisements. The client must not otherwise alter the images, for example by retouching, re-colouring, changing the people, products or scene, or creating AI-generated or AI-altered versions, because that can misrepresent Mevista’s work and the people shown. Credit is not required unless the quote says so.
19. Business work: permissions, materials, confidentiality and portfolio use
The business client confirms it has authority to provide logos, products, premises, music and other supplied material for the agreed project, and obtains participant or third-party permissions needed for the client’s intended uses. The rules in clause 5 apply to access and property permission, including a business booking at its own premises. A person appearing at a business shoot is not automatically consenting to Mevista marketing. Portfolio use of the work follows clause 9: Mevista may show the work and identify the client as an example of its work unless the client opts out, but uses images of an identifiable person only with that person’s separate, optional permission. The quote states whether a draft or preview is supplied and how many revision rounds are included. A revision is a consolidated request to adjust the supplied draft within the approved brief. New concepts, reshoots, changed direction, additional deliverables and changes after approval are outside the included revision scope unless the quote says otherwise. Mevista obtains written approval before charging for extra work. Special confidentiality, embargo or launch dates must be written in the quote.
20. Vehicle sale listings by dealers and salespeople
This clause applies where a dealership, salesperson or other business books photography to advertise vehicles for sale. The images of each vehicle are licensed only to advertise and sell that vehicle, on the channels stated in the quote (for example the dealer’s website, listing platforms and social media). Once the vehicle is sold, the client may not use the images for that vehicle or for any other purpose, including general marketing or as stock images for other vehicles, and must promptly remove them from live listings and advertising. The images may not be used for a different vehicle, including a similar one.
Mevista photographs vehicles as presented and is not responsible for the accuracy of the client’s vehicle descriptions or listings. Mevista keeps copyright and may use the images in its portfolio under clause 19. The delivery target for vehicle sale-listing sessions is in clause 8.
Part D — UGC projects only
21. UGC scope and expectations
This part applies to user-generated-style content created for a brand or business. The quote describes the content, formats, quantity, length, platform, delivery files, deadline and whether Mevista appears on camera or uses a personal social account. UGC describes a content style; it does not promise influencer posting, audience reach, advertising performance or a particular sales result, and Mevista is not responsible for platform decisions such as removals, restrictions or ad-account issues. The quote states how drafts are reviewed, how many revision rounds are included and the delivery method. A new concept, reshoot, substantial script change, new deliverable or changed campaign direction may require a new quote.
Creative control and product: Mevista keeps creative control over how she presents herself, her voice and her style within the agreed brief. Scripts, talking points and hooks supplied by the client are guides. The client supplies product in good time so Mevista can genuinely try it before filming. Product supplied by the client is at the client’s cost, is not payment unless the quote says so, and may be kept by Mevista unless the quote says it is to be returned. Delays in supplying product, information, feedback or approvals can move delivery dates.
22. UGC licence, approvals and usage
Copyright and licence: Mevista retains copyright in original content it creates unless the quote expressly states a different written arrangement. The client receives a licence only after the agreed price is paid in full; until then Mevista may supply previews only or withhold final files. The licence is non-exclusive and non-transferable unless the quote says otherwise. The quote must state permitted platforms and channels, purpose, territory and term, and whether paid ads, whitelisting, creator-handle access, exclusivity, edits or sublicensing are included. No use not stated in the quote is granted. When the term ends, the client stops using the content and ends any paid promotion of it, unless the quote says previously published organic posts may remain.
Whitelisting and creator-handle access: Where the quote includes whitelisting or creator-handle access, it is limited to the platform’s authorised partnership or ad-permission tools, for the stated term and campaign. Mevista never shares account passwords, keeps control of her accounts, and may end access when the term ends or if the client breaches these terms or platform rules. The client must not post or advertise as though it were Mevista, or attribute to her any statement she has not made.
Raw footage and edits: If the quote includes raw or unedited footage, the client may edit it for the licensed use. Before an edited version is published or promoted, the client must send it to Mevista for approval. Mevista will not unreasonably withhold or delay approval, and may refuse it where the edit misrepresents Mevista, changes the meaning of what she said or did, adds a claim she has not made or cannot support, or does not match the agreed brief. Mevista’s consent to edits covers only the approved version.
Likeness, voice and AI: The client may use Mevista’s face, voice, name and handle only within the approved content and the uses stated in the quote. Unless the quote expressly allows it, the client must not use the content to create AI-generated or synthetic versions of Mevista’s face, voice or likeness, or to train or improve any AI model. If another identifiable person appears in the content, any client use of that person’s image or performance must be covered by separate permission for the specific project and uses. A client’s acceptance does not grant publicity permission on another person’s behalf. Third-party music, stock, fonts, platform assets or supplied materials remain subject to their own licences.
Posts on Mevista’s own accounts: Where Mevista posts on her own account, she keeps editorial control and ownership of the account and the post. The post stays live for the period stated in the quote (if any), and Mevista will remove or amend it on a reasonable written request if a claim in it becomes inaccurate, unlawful or unsafe.
23. UGC claims, advertising rules and genuine opinions
Client claims: The client supplies accurate product information (including ingredients, directions and warnings) and evidence for any health, performance, comparative or other factual claim it wants made. The client is responsible for ensuring that the product, its claims and the scripts, talking points, hashtags and instructions it supplies comply with the law and platform rules, including the Australian Consumer Law and, for products or claims that fall under therapeutic goods rules (for example sunscreen, acne, treatment or other health claims), the therapeutic goods laws and advertising requirements. Mevista does not give legal or regulatory advice and is not responsible for the accuracy or lawfulness of client-supplied claims or instructions. Mevista may decline, change or leave out any claim or request that appears misleading, unsafe, unlawful or unsupported.
Genuine opinions: Mevista presents only her genuine opinions, experiences and results, and does not promise a favourable opinion. She will not say or imply that she has used a product, tried a service or achieved a result when she has not, and may reword a script to match her real experience. Giving an honest opinion is not a breach of the quote. If Mevista finds that a product is unsafe or does not match the client’s claims, she may raise it with the client and pause the work. If the concern cannot be resolved, the parties may end the project; Mevista then refunds amounts paid for work not delivered and may keep a reasonable amount for work completed.
Safety: Mevista may decline to use, apply, eat, drink or demonstrate a product, or to carry out an activity, that she reasonably considers unsafe, unsuitable or unlawful. That is not a breach of the quote.
Advertising disclosure: Where content is paid, gifted or otherwise promotes the client’s product, it must be clearly identified as advertising where the law or platform rules require (for example, by using the platform’s paid-partnership label or a clear tag such as #ad). Mevista includes required disclosures on her own posts. The client must not remove or hide a disclosure or ask Mevista to leave one out, and is responsible for disclosure when it publishes or promotes the content on its own accounts or channels, including in paid ads.
Responsibility: The client is responsible for, and will reimburse Mevista for reasonable losses, costs and claims arising from, any claim that the product, the client’s claims, scripts, instructions or supplied materials, or the client’s use of the content outside the licensed uses or the approved edits, are false, misleading, unlawful or unsafe or infringe a third party’s rights.
